This has become particularly pertinent in 2020 following changes to the so-called expat tax which have removed the exemption from tax on foreign income for South Africans living abroad.<\/p>\n<p>The South African Revenue Service (SARS) assesses liability for tax on the following criteria:<\/p>\n<ol>\n<li><strong> Ordinary Residence<\/strong><\/li>\n<\/ol>\n<p>A common definition is as follows: \u2018his ordinary residence would be the country to which he would naturally and as a matter of course return from his wanderings\u2019<\/p>\n<p>SARS themselves admit that \u2018It is not possible to lay down hard and fast rules\u2019 so every case is assessed on its own merit taking into account many factors including where a person lives and does business, where their family live, nationality, location of personal belongings etc.<\/p>\n<p>You can find further information from SARS on ordinary residence <a href=\"https:\/\/www.sars.gov.za\/AllDocs\/LegalDoclib\/Notes\/LAPD-IntR-IN-2012-03%20-%20Resident%20definition%20natural%20person%20ordinarily%20resident.pdf\">here<\/a>.<\/p>\n<ol start=\"2\">\n<li><strong> Physical Presence Test<\/strong><\/li>\n<\/ol>\n<p>The \u2018physical presence\u2019 test determines if someone is tax resident in South Africa by checking the number of days they spend in the country.
